Privacy Policy

This policy explains what personal information we collect through benvcat.org, how we use it, and the choices and rights you have, including under the California Consumer Privacy Act (CCPA), as amended by the CPRA, and the California Online Privacy Protection Act (CalOPPA).

Who We Are

This website is operated by Ben V. Cat, a California real estate salesperson (DRE #02030696) and mortgage loan originator (NMLS #1597078) licensed under responsible broker Century Financial Group, Corp. (DRE #01930905), 8295 Bolsa Avenue, Midway City, CA 92655. In this policy, “we,” “us,” and “our” refer to Ben V. Cat and his responsible broker.

Information We Collect

Information you give us

When you use the forms on this site, we collect:

  • Consultation request form: your name, email address, phone number (optional), your real estate objective, and any property details, timelines, or questions you choose to share. If you schedule a strategy call, we also collect your preferred and alternate dates and time of day.
  • Playbook download form: your name, email address, and phone number (optional).
  • Your communication choices: whether you opted in to text messages or marketing email, and when.
  • Direct contact: anything you send us by phone, email, or text.

The mortgage payment estimator runs entirely in your browser. The numbers you enter are not sent to us or stored.

Information collected automatically

  • Technical data: like most websites, our hosting provider records standard server logs such as IP address, browser type, pages requested, and the date and time of each visit. We use these logs for security and to keep the site running.
  • Spam protection: our forms use Cloudflare Turnstile, which checks browser and device signals (such as IP address) to tell people apart from bots, subject to Cloudflare's privacy policy. Forms also include a hidden field that helps us filter automated submissions.
  • Browser storage: your browser stores a note that you have acknowledged the site disclaimer and, if you use the language selector, a googtrans cookie that remembers your chosen language.
  • Voice assistant (when available): if you start a conversation with the AI voice assistant on this site, the audio and a transcript of the conversation are processed by our voice provider, ElevenLabs, and may be recorded and retained so we can respond to you. Do not start a voice conversation if you do not want it recorded.

Sensitive information

Please do not send Social Security numbers, bank or account numbers, or other sensitive financial details through the website forms. If you apply for a mortgage, we will collect that information through a separate, secure loan application process that is covered by additional privacy notices required under federal law.

How We Use Information

  • To respond to your inquiry and schedule consultations.
  • To send you the materials you request, such as the playbook.
  • To provide real estate brokerage and mortgage services you ask us for.
  • To send marketing email or text messages, only if you opt in. You can opt out at any time.
  • To keep records required of real estate and mortgage licensees, to comply with law, and to protect against fraud and misuse of the site.
  • To maintain and improve this website.

How We Share Information

We share personal information only as follows:

  • Our responsible broker, Century Financial Group, Corp., which supervises our real estate and mortgage activity and must keep certain records under California law.
  • Service providers who help us run the site and communicate with you, such as website hosting, our form-processing and email automation service (n8n), spam protection (Cloudflare), and the voice assistant provider. They may use the information only to provide services to us.
  • Parties to your transaction, such as lenders, escrow, title, inspectors, or another agent, but only at your direction or as needed to complete a transaction you have asked us to handle.
  • Legal and safety reasons, when required by law, subpoena, or a regulator such as the California Department of Real Estate, or to protect rights and safety.

Translations are provided by Google Translate. When you choose a language, the text of the page is sent to Google to be translated, subject to Google's own privacy policy.

No Sale or Sharing

We do not sell your personal information, and we do not “share” it for cross-context behavioral advertising, as those terms are defined in the CCPA. We have not done so in the preceding 12 months. We do not use your information for targeted advertising, and we do not knowingly sell or share the personal information of anyone under 16.

Calls, Texts & Email

  • When you submit a form, we will contact you by email, or by phone if you provide a number, about your inquiry.
  • We send text messages only if you check the text message consent box. Consent is not a condition of any purchase or service. Message and data rates may apply. Reply STOP to any text to opt out, or HELP for help.
  • We send marketing email only if you opt in. Every marketing email includes an unsubscribe link. You can also opt out by emailing info@benvcat.org with “Unsubscribe” in the subject line. We will process opt-outs within 10 business days.
  • Calls with our office and conversations with the voice assistant may be recorded for quality and record-keeping. We will tell you at the start of a recorded phone call.

Cookies & Do Not Track

We do not use advertising cookies or third-party analytics on this site. The only browser storage we use is described above. Most browsers let you block or delete cookies; if you do, the language selector and disclaimer may not remember your choice.

Do Not Track and Global Privacy Control. We do not track visitors across third-party websites. Because we do not sell or share personal information, there is nothing for a Do Not Track or Global Privacy Control signal to switch off, but we treat a GPC signal as a valid request to opt out of sale and sharing.

Retention & Security

We keep inquiry information for as long as needed to respond to you and provide services. Where a transaction occurs, California law requires real estate brokers to keep transaction records for at least three years, and mortgage records may need to be kept longer. We delete or anonymize information when it is no longer needed.

We use reasonable administrative, technical, and physical safeguards to protect personal information. No website or email transmission is completely secure, so please do not send sensitive financial information through the site.

Your California Rights

If you are a California resident, you have the right to:

  • Know what personal information we have collected about you, where it came from, why we collected it, and who we disclosed it to.
  • Delete personal information we collected from you, subject to legal record-keeping exceptions.
  • Correct inaccurate personal information.
  • Opt out of the sale or sharing of personal information (we do neither).
  • Limit the use of sensitive personal information (we do not use it for purposes that would trigger this right).
  • Not be discriminated against for exercising any of these rights.

To make a request, email info@benvcat.org or call (714) 409-9159. We will confirm receipt within 10 business days and respond within 45 days. We will verify your identity by matching information you provide against what we hold. You may use an authorized agent; we may ask for proof of the agent's authority.

Under California's “Shine the Light” law, you may also ask whether we disclosed personal information to third parties for their direct marketing purposes. We do not.

Children

This site is intended for adults. We do not knowingly collect personal information from children under 16. If you believe a child has submitted information, contact us and we will delete it.

Changes & Contact

We may update this policy from time to time. We will post the updated policy on this page with a new effective date. Material changes will be highlighted on the site.
